For the other 19, the card gives the fees state law sets in every county, quoted from the statutes, and the official recorder link. Tap a county to open it.

The $75 question

How the statute reads for a trust deed

1The fee

“a fee of seventy-five dollars ($75) shall be paid at the time of recording of every real estate instrument, paper, or notice required or permitted by law to be recorded, except those expressly exempted from payment of recording fees, per each single transaction per parcel of real property. The fee imposed by this section shall not exceed two hundred twenty-five dollars ($225)”

Gov. Code 27388.1(a)(1)

2The two exemptions that can apply to a home

“(A) Any real estate instrument, paper, or notice recorded in connection with a transfer subject to the imposition of a documentary transfer tax as defined in Section 11911 of the Revenue and Taxation Code.” ... “(B) Any real estate instrument, paper, or notice recorded in connection with a transfer of real property that is a residential dwelling to an owner-occupier.”

Gov. Code 27388.1(a)(2)

Exemption (A) does not apply to a deed into your own trust. (A) covers a transfer that is subject to the documentary transfer tax. A deed into your own living trust is exempt from that tax under Revenue and Taxation Code 11930, so it is not subject to it. Los Angeles County’s wording for that deed:

“This conveyance transfers an interest into or out of a Living Trust, R & T 11930.”

Los Angeles County

Exemption (B) is the one written for a home you live in. The statute does not define “owner-occupier,” and none of the county recorder pages quoted here says whether a deed into the owner’s own trust qualifies. That call is made when the deed is prepared.

3How counties apply it

The statute sets the fee and the exemptions. How an exemption is declared is county practice:

“a valid declaration of exemption must be shown on the face of the document or on a cover page ... If no valid exemption is declared, the fee will be applied.”

Ventura County fee schedule

“If no valid exemption is declared, the fee will be assessed.”

Los Angeles County

Where a county publishes its own exemption statement, its card above quotes it.

Property tax: the revocable trust exclusion

Change in ownership exclusion for trusts, Revenue and Taxation Code section 62(d)

"Any transfer by the trustor, or by the trustor’s spouse or registered domestic partner, or by both, into a trust for so long as" ... "(1) the transferor is the present beneficiary of the trust, or (2) the trust is revocable". Section 62 opens with: "Change in ownership shall not include:"

Official text

Property tax: State Board of Equalization Rule 462.160

Property Tax Rule 462.160, subdivision (b)(2)

“(b) EXCEPTIONS. The following transfers do not constitute changes in ownership:” ... “(2) Revocable Trusts. The transfer of real property or an ownership interest in a legal entity holding an interest in real property by the trustor to a trust which is revocable by the trustor. However, a change in ownership does occur at the time the revocable trust becomes irrevocable unless the trustor-transferor remains or becomes the sole present beneficiary or unless otherwise excluded from change in ownership.”

Preliminary Change of Ownership Report, Revenue and Taxation Code section 480.3(b)

Why the deed matters

A living trust only holds what is put into it. For most families the largest thing to move is the home, and that move is a deed recorded in the county where the property sits.

Quoted from California statutes and county government sources, checked November 1, 2026. Legal information, not legal advice for a specific property. The Flaig Law Firm, APC, Donald W. Flaig, Esq., 5707 Corsa Avenue, Suite 104, Westlake Village, CA 91362.

Your home, in your trust.

The Flaig Law Firm prepares the deed that moves your home into your living trust, with the transfer tax statement, the SB2 declaration and the PCOR, and records it with the recorder in the county where your home sits.
